EU Member States were unable to reach final agreement on Community Patents in 2004, in particular on the issue of translations of the Community Patent.  In March 2007 the European Commission released a Communication on the problems with the current patent system in Europe and setting out proposals regarding a potential compromise between the draft European Patent Litigation Agreement and proposed European Community patent:

In January 2008 the EU Presidency published a working document on European patent jurisdiction (register.consilium.europa.eu/pdf/en/08/st05/st05245.en08.pdf) and in February 2008 a further working document containing proposals regarding translations and the sharing of revenue (register.consilium.europa.eu/pdf/en/08/st06/st06985.en08.pdf). In March 2009 the Commission sent a recommendation to the European Council requesting authorization to open negotiations for the adoption of an agreement creating a unified patent litigation system (http://ec.europa.eu/internal_market/indprop/docs/patent/recommendation_sec09-330_en.pdf).
