This guidance explains amendments to the Code of Conduct approved in March 2010 which relate to different business structures through which barristers may now provide their services. It also explains how barristers may now work in what is known as ‘dual practice’ by continuing their self employment while working for an employer such as the Serious Fraud Office or as a manager of a Legal Disciplinary Practice.

This guidance covers four aspects of barristers’ work and practice management which have been changed fundamentally by recent amendments to the Code of Conduct. These are:

  • investigating or collecting evidence and taking witness statements
  • conduct of correspondence
  • sharing premises
  • attendance at police stations.
