PROTOCOL 14
Russian Parliament (Duma) agreed Russia’s ratification of Protocol 14 on 15th January 2010. The Protocol, which requires the consent of all the members of the Council of Europe) can now be brought into effect. This is after three months following final ratification by all states. The Protocol introduces important reforms to the procedure of the Court of Human Rights and also to the admissibility test under article 34 (these changes are mentioned at various places in the text of Chapter 2 and are summarised in Chapter 2, 2.9). Their introduction should enable the Court to begin to deal with the backlog of cases (though it is unlikely to resolve the issue) and make it more effective in performing its role of defending the human rights of individuals in Europe. A provisional Protocol (14 bis), which would have introduced some of the reforms in Protocol 14 without the need for Russian approval, will not be brought into effect if Protocol 14 is introduced.
