Question 1

  • Consider the scope of Article 3. In particular what is meant by "the legislature". (See 26.5)

  • Does the Convention satisfy the requirements found in Article 25 of the ICCPR on public participation? (See 26.5.2).

  • Consider whether a combination of Article 3 of the First Protocol linked with other rights, such as freedom of expression (Article 10) and freedom of association (Article 11), is sufficient for full public participation.
