Question 1

  • Note the basic right (see 25.2 and the Belgian Linguistics case). Note, too, that the existence of (at least) universal primary education is presumed in the Court's judgments.

  • The basic right is a minimum – consider what else is expressed or implied in, for example, the court's concept of a pluralist and diverse education. (See 25.2 and 25.3)

Question 2

  • Consider the nature of the second sentence right and the way it is balanced with the right of the state to regulate education in the public interest. (See 25.5)
