Question 1

  • Consider whether wearing insignia is within the scope of Article 10. (See 19.7)

  • If Article 10 is engaged, what is the general approach that a court will adopt to decide whether Article 10 is violated? (See 19.5 and 19.6, "section 12 HRA" )

  • Is the "promotion of good race relations" a legitimate purpose for which freedom of expression can be restricted? If it is not, what, if any, might be the legitimate purpose of such a ban? (See 19.9.3)

  • In issue is both political speech and racist speech – how are these issues to be treated by a court under the Convention? What other Convention Article might be involved? (See 19.12.3)
