  • How does the Court of Human Rights define the concept of a "penalty" and has prisoner 1234's "penalty" been increased? (see 13.4.2 and cases such as Welch v United Kingdom)

  • Does "penalty" cover, for example, actions taken by the state aimed at deterring would be offenders, preventing crime and anti-social behaviour or compensating the state or victims? (see 13.4.2.2.)
