Clayton: Textbook on Immigration & Asylum Law 3e

Chapter 5

1. Why do you think the UK negotiated an opt-in arrangement to the Treaty of Amsterdam?

Read some of the reading list material on the Treaty of Amsterdam. Remember an opt-in gives the UK choice about whether to participate. Consider the measures the UK has opted into and those it has not. Consider why the UK might want this with reference both to its geography - as an island nation - and its history - its relationships with Commonwealth countries. Section 5.10 in this chapter may help.

This essay may be written quite briefly. Alternatively, it could be extensive, if a significant level of research and reading is done.

2. What are the benefits to the UK of opting in to the EU measures on asylum?

Consider for instance the benefits of the Dublin Regulation, the Refugee Qualification Directive, Eurodac, the Procedures Directive. It may help to read the section on safe third countries in chapter 12.

This essay could be extensive, if each of these measures is treated in detail. It could be a more contained exercise by simply taking one measure and considering its effect in detail, or made briefer by simply giving a general account of the benefits of each of these measures without great detail.

3. What do you think motivated the EC to enter into the Association Agreements?

This is a potentially broad-ranging question that could entail examination of historical, political and social issues. Instead of necessarily embarking on that research and writing, you could treat it just as a thought bubble - something to keep in mind as you read - what are the benefits to the EC/EU of such agreements, as opposed to the benefits to the third states? The latter are more obvious.
