This is the transcript of Case 48/65. In proceedings brought against the European Parliament, the Council or the Commission under Article 232 EC, the action will be admissible only if the institution in question has been called to act, and within two months of being called, the institution has not defined its position. Although the Article itself is silent as to what happens if the concerned institution defines its position, the Court held that a definition of position brought proceedings under Article 232 to an end.
