There is little in the general area of community care we can recommend. Regrettably much published material is out of date, or too specialized. However an exception is:

L. Clements and P. Thompson, Community Care and the Law (4th revised edn. Legal Action Group, 2007) - provides a comprehensive overview of all aspects.

As a source of reference you will find all the primary materials you need, including circulars, in R. Jones, Encyclopedia of Social Services Law (first published 1993 updated by looseleaf inserts, Sweet & Maxwell).

The following are all recommended as sources of information:

G. Ashton, Elderly People and the Law (2nd edn., Butterworths, 2005). The author is a leading lawyer in this field and also a judge. An authoritative textbook covering all important issues.

G. Ashton (ed.), Butterworths Older Client Legal Service (Butterworth, looseleaf). This contains primary source material as well as explanations, and is updated periodically. A valuable reference tool.

M. Mandelstam, Community Care Practice and the Law (3rd edn., Jessica Kingsley Publishers, 2005). As well as providing a good overview the book is useful for its case reports from the
courts and, importantly, the ombudsman.

Department of Health, A Practical Guide for Disabled People or Carers, published at www.dh.gov.uk/en/Publicationsandstatistics/Publications/PublicationsPolicyAndGuidance/DH_4007111 - a good entry point providing a comprehensive overview of provision and criteria, plus links to other organizations.

A number of books on mental capacity are useful, though the Code is probably the best starting point.

Mental Capacity Act 2005 Code of Practice (DCA, 2007) - contains essential guidance to anyone working professionally with people who may lack capacity. See www.justice.gov.uk/docs/mca-cp.pdf.

R. Brown, and P. Barber, The Social Worker's Guide to Mental Capacity Law (Learning Matters, 2007).

M. Terrell, P. Letts, and L. Oates, Mental Capacity: The New Law (Jordan Publishing, 2007).
