Brayne & Carr: Law for Social Workers 10e
Chapter 4
Confidentiality
R v Taylor, 'Re S (A Child) (Identification: Restrictions on Publication) and A Local Authority v W: children's privacy and press freedom in criminal cases' 2006 18(2) CFLQ 269. This commentary considers the decisions in two difficult cases which raised the question of whether the courts can and should restrain publication of the identity of defendants in criminal trials in order to protect the welfare of their children. The cases reveal the ways in which the courts seek to reconcile press freedom and the privacy of the vulnerable.
Information sharing
C. Cobley, '"Working Together?" - Admissions of Abuse in Child Protection Proceedings and Criminal Prosecutions' 2004 CFLQ. This article considers the way in which information is exchanged between the child protection and criminal justice systems. It suggests that tensions between the two systems increase as cases progress.
