Regulated football matches p 961

For 'England and Wales' in the first and second lines there is substituted by the Policing and Crime Act 2009 (P&CA 2009), s 103, 'the United Kingdom'.

The Football Spectators (Prescription) Order 2004 was amended by the Football Spectators (Prescription) (Amendment) Order 2010 (SI 2010/584).

Paragraphs 2-4 on p 961 are replaced with the following definitions.

Regulated football match in England and Wales

This is an association football match:

  1. in which one or both of the participating teams represents:
    1. a club which is for the time being a member (whether a full or associate member) of the Football League, the Football Association Premier League, the Football Conference, the Welsh Premier League, the Scottish Premier League or the Scottish Football League;
    2. a club whose home ground is for the time being situated outside England and Wales; or
    3. a country or territory; or
  2. which is played in the FA Cup, other than a preliminary or qualifying round.

It is no longer a requirement that, to be a regulated match, the match must be played at a specified type of ground.

Regulated football match outside England and Wales

This is an association football match involving:

  1. a national team appointed by the Football Association to represent England or the Football Association of Wales to represent Wales;
  2. a team representing a club which is for the time being a member (whether a full or associate member) of the Football League, the Football Association Premier League, the Football Conference, the Welsh Premier League, the Scottish Premier League or the Scottish Football League;
  3. a team representing any country or territory whose football association is for the time being a member of FIFA where the match is part of a competition or tournament organised by or under the authority of FIFA or UEFA and the competition is one in which a national team referred to in (a) is eligible to participate, or has participated;
  4. a team representing a club which is for the time being a member (whether a full or associate member) of, or affiliated to, a national football association which is a member of FIFA, where the match is part of a competition or tournament organised by, or under the authority of, FIFA or UEFA and the competition is such that a club from the Football League, the Football Premier League, the Football Conference or the Welsh Premier League is eligible to participate, or has participated; or
  5. a team representing a country or territory in the 2012 Olympics.

Banning orders following a conviction for a relevant office p 962

Delete the reference in (a) to FSA 1989, s 2(1) (unauthorised attendance).

An offence under FSA 1989, s 19(6) (failure to comply with a requirement made at initial reporting at a police station: see pp 965 and 966) or s 20 (10) (person subject to banning order knowingly or recklessly providing false or misleading information in support of his application for exemption from requirements imposed under FSA 1989), and an offence under the Police, Public Order and Criminal Justice (Scotland) Act 2006, s 68 (1) or (5) (corresponding offences) were added to (a) by P&CA 2009, s 107.

The effect of a banning order p 964

For 'England and Wales' on both occasions where it appears under this heading, there is substituted by P&CA 2009, s 103, 'the United Kingdom'.

The provisions relating to travel authorisations are now in force.

Reporting at a police station p 965

For ‘England and Wales’ on each occasion where it appears under this heading, there is prospectively substituted by P&CA 2009, s 103, ‘the United Kingdom’, and ‘if the match is outside the United Kingdom’ in the penultimate line of the second paragraph on p 966 is prospectively deleted by P&CA 2009, s 103.

The provisions relating to travel authorisations are now in force.

Failure to comply with a requirement p 966

In the second to fourth lines of (b)(i), the words 'if the match is outside the United Kingdom and the order requires the surrender of a passport (prospective travel authorisation)' are deleted by P&CA 2009, s 103.

Summary measures p 966

For ‘England and Wales’ in the first paragraph on p 967 under this heading, there is substituted by P&CA 2009, s 103, ‘the United Kingdom’.

The provisions relating to travel authorisations are now in force.

Enforcement in England and Wales of the Police, Public Order and Criminal Justice (Scotland) Act 2006, s68 p 967

Add the above heading and the following text before TICKET TOUTS on p 967.

The following provisions of the Police, Public Order and Criminal Justice (Scotland) Act 2006 have been extended to England and Wales by P& CA 2009, s 106:

  1. s 68(1) and (2) (offences of failing to comply with a requirement imposed by a football banning order, under s 61(1) or by a notice under s 61(4), and defence of reasonable excuse);
  2. s 68(5) (offence of making a false statement, etc. in connection with an application for exemption from a notice under s 61(4)).
