On 1 October 2009 the Supreme Court replaced the House of Lords as the supreme court of appeal in the English legal system. Henceforth, its decisions will have the same binding effect as those of the House of Lords.

The Court of Appeal has rejected the view that attribution of the acts and state of mind of an individual to a corporation was always limited to the acts and state of mind of an individual who could be identified with the corporation as part of its 'directing mind and will'. It held that whether or not the conduct of a particular employee of a corporation could be attributed to the corporation for the purposes of criminal liability for a statutory offence depended on the proper construction of the particular rule of law concerned.
