The RSA 2006, s 26 introduced a new s 41D into the RTA 1988 which provides for discretional disqualification and the obligatory imposition of three penalty points, for offences against regulation 104 (control) and regulation 110 (mobile phones. The offences are also made fixed penalty offences.
