Page 21 'In respect of a witness'

Serious Organised Crime and Police Act 2005, s 169 has amended the Magistrates' Courts Act 1980, s 97 so that it provides that justices may issue such a summons if it is in the interests of justice to do so to secure attendance to give evidence or produce a document or thing. This requirement replaces that mentioned in the text, viz that the witness was unlikely to attend court.

The provisions of the Criminal Justice Act 2003, Pt 7 which relate to applications by the prosecution for a trial to be conducted without a jury where there is a danger of jury tampering were brought into force with effect from 24 July 2006.
