Chapter 15 - Traffic Accidents

Duty to Report to the Police p 516

A driver who was rendered unconscious by an accident and therefore could not provide particulars to police officers attending the scene of the accident at the time, and who discharged himself from hospital before he could be seen by police officers, was held to be guilty of an offence of failing to report an accident. A divisional court said that the wording of s 170 is quite clear; where the information required by the section is not provided, the accident must be reported. [DPP v Hay (2005) Times, 13 July]
