Chapter 73 Appeals to the House of Lords
Supreme Court
By the Constitutional Reform Act 2005, ss 23-60 (not yet in force), the newly constituted Supreme Court of the United Kingdom will replace the House of Lords as the highest court in the land. It will have a President, Deputy President, and 10 Justices of the Supreme Court. Appeals from the CA can only be made with permission from the Court of Appeal or the Supreme Court (s 40(6)). It will sit with an uneven number of judges, being at least 3 in number with a majority being permanent justices (s 42(1)). Supreme Court Rules governing procedure may be made under s 45.
The Supreme Court of England and Wales (High Court, Court of Appeal and Crown Court) will be termed the "Senior Courts of England and Wales" (s 59(1)).
